JestSMS Terms of Service & Privacy Policy

1. Terms of Service

• Eligibility: You must be at least 18 years old and legally able to enter into contracts.
• Account Registration: Provide accurate and complete information. Keep credentials confidential.
• User Responsibilities: Only use JestSMS for lawful purposes. Prohibited activities include, but are not limited to:
  • Sending spam, phishing, or unsolicited messages
  • Harassment, threats, or abusive content
  • Fraudulent, deceptive, or illegal content
  • Mass marketing without proper consent
• Compliance: Users must comply with local laws, including anti-spam and electronic communications regulations.
• SMS Content: You are responsible for all content sent using JestSMS. Jhuxtello iTech may block or suspend accounts that violate these rules.
• Service Availability: JestSMS strives for high uptime but cannot guarantee uninterrupted service.
• Payment: SMS credits must be purchased. Credits are non-refundable once messages are sent. Unused credits may be subject to expiration.
• Termination: Accounts violating these terms may be suspended or terminated immediately. Users can request account deletion at any time.

2. Privacy Policy

• Information Collected: Account info, group contacts, message content, payment info, usage logs, and IP addresses.
• Use of Information: To provide services, send messages, verify accounts, prevent fraud, and improve our platform.
• Sharing: We do not sell personal information. May share data with:
  • Payment processors
  • Legal authorities if required by law
  • Service partners solely for platform functionality
• Data Retention: We retain personal data until account deletion or as required by law. Logs of sent messages may be retained for audit or compliance purposes.
• Security: Reasonable administrative, technical, and physical safeguards are used. However, no online service is completely secure.

3. Account Deletion / Data Removal

You may request deletion of your JestSMS account at any time. Upon deletion:

• All account data, contacts, message logs, and SMS credits will be removed permanently.
• Messages that were already sent cannot be reversed or recovered.
• Deletion requests are processed within 5 business days.

4. SMS Sending Guidelines

• Do not send messages to users who have opted out or unsubscribed.
• Do not use false sender IDs or spoofed phone numbers.
• Do not send messages promoting scams, phishing, or malicious software.
• Limit message frequency to prevent abuse and complaints.
• Ensure recipients have provided consent for marketing messages.

5. Limitation of Liability

JestSMS and Jhuxtello iTech are not liable for indirect, incidental, or consequential damages. We are not responsible for delivery failures due to third-party networks or errors caused by user content.

6. Changes to Terms

We may update these terms at any time. Continued use of JestSMS constitutes acceptance of any updates. We recommend reviewing the Terms regularly.

7. Governing Law

These terms are governed by the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of Ghanaian courts.
